In 1966, the Supreme Court decided Miranda v. The suits brought under this statute are often referred to as “Section 1983 suits.” The Supreme Court recently decided an important issue arising under §1983. This provision of law is well known to people who work in the criminal justice system, because it is not uncommon for police officers, prison and jail employees, and other criminal justice personnel to be sued under this statute. Call, Retired Professor of Criminal Justice, Radford University, E-mail: 1983 to Title 42 of the United States Code provides that any person acting under color of state law who subjects a person or “causes to subjected … to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws” may be sued for that deprivation by the person whose rights were violated.
